1. Purpose

These conditions are intended to define the terms of sale between SOEUR and the user, from ordering to services, including payment and delivery. They govern all the steps required to place an order and ensure the follow-up of that order between the contracting parties.

2. Order

Any order constitutes acceptance of the prices and description of the products available for sale, as well as the general terms and conditions of sale. Any dispute on this point will be addressed within the framework of a possible exchange and the warranties mentioned below.

SOEUR undertakes to fulfil orders received on the website solely within the limits of available stock. In the event that a product is unavailable, SOEUR undertakes to inform the user.

3. Shipping costs and delivery

Shipping costs are borne by the user and depend on the country of delivery. They will be specified to the customer upon order confirmation.
Delivery in metropolitan France and in Belgium to a collection point is free of charge.
We also offer a Click & Collect service, allowing you to order online and collect your order directly in store.

Ordered items will be delivered to the address provided by the user.

Orders placed before 12:00 pm are prepared and dispatched on the same day. Orders placed after 12:00 pm will be dispatched the following day.*

*Please note that the preparation times indicated above may be longer during our sales events, sales and/or promotions.

Delivery times begin from this date. Except in the case of special operations, and subject to available stock, they will be 24 to 72 hours for France, and approximately 3 working days for international destinations, depending on the destination and chosen delivery method.

*Delivery times are given as an indication by our transport providers and may also vary depending on the time of year.

For deliveries outside the European Union, we do our utmost to facilitate customs clearance with our delivery provider so as not to delay your order. In certain cases, however, the delivery time may be extended due to customs inspections beyond our control.

All our deliveries require a signature upon receipt, except during periods of lockdown or when advised otherwise by our providers. SOEUR does not deliver to PO boxes.

In the event of absence, a delivery notice must be left in the recipient's letterbox. The customer has 15 days to collect the parcel from their local post office.

At any time, you can track your parcel on the Chronopost, La Poste and DHL websites.

In the event of a delay, SOEUR cannot be held liable, for any reason whatsoever. Consequently, no claim for compensation of any kind may be made by the user against SOEUR.


Note: For any delivery outside the European Union, customs duties and additional taxes may apply. This information will be indicated at the checkout stage of your order.

4. Pricing, payment and invoicing

Prices are quoted in euros inclusive of all taxes, except for countries outside the European Union. These prices do not include handling costs (postage, packaging and parcel preparation according to current rates). Any change in the applicable rate may be passed on to product prices. After this date, prices are subject to change at any time. However, prices may not be modified once the customer's order has been placed. Likewise, should one or more taxes or levies be introduced or amended, whether upwards or downwards, this change may be reflected in the sale price of items on the SOEUR website.

The prices shown on the website are guaranteed for the duration of their online availability and subject to available stock.

The final price invoiced to the customer is the price shown on the order confirmation.

Payment is made by bank card bearing the Visa, Eurocard, Mastercard or American Express logo. You may also pay via PayPal. Your bank account will be debited upon validation of your order. As banks always apply a processing delay, payment validation may sometimes take one day from the time the order is confirmed. The product invoice will be included in the parcel containing the ordered product.

The use of discount codes obtained from fraudulent websites or social media is not valid on our site.

5. Right of withdrawal, returns and exchanges

All items from the current collection that are not in the sale may be exchanged (subject to availability) or refunded. Sale items or end-of-line items may be refunded.

For France, returns are free via Colissimo and in store (see procedure here) within fourteen working days from the date of receipt or collection of the parcel. For other countries, please see the procedure here. Items from the Archives Sale relating to previous collections may be returned free of charge via Mondial Relay only and will not be accepted in store.

The right of withdrawal may be exercised either directly by going to "My order" or "My account", or by completing and sending the withdrawal form template set out in Annex 1 of the General Terms and Conditions of Sale, by post to the following address: LOGTEX – Service Retours SOEUR – ZI Artoipole 2 Allée de Belgique – 62128 WANCOURT, France, or by email to serviceclient@soeur.fr.
The customer may not exercise their right of withdrawal for a product made to their specifications, or one that has been used, worn, washed, damaged or unsealed.

It is the user's responsibility to retain all proof and the date of return. In the case of an exchange, new delivery costs will not be charged to the customer. Refunds will be processed within 10 working days of receipt of the parcel.

Only one return is permitted per order. Should the customer wish to make an additional return, this must be arranged and covered at their own expense.

If the customer has chosen a store credit as their refund method when confirming their return request, once the credit has been issued, it will unfortunately no longer be possible to request a bank refund.

6. Warranties and disputes

All items are subject to a contractual warranty, which does not preclude the statutory warranty provided for in Articles 1641 et seq. Of the Civil Code. The user also benefits from a warranty enabling them to return defective items delivered, in accordance with Articles L. 211-4 et seq. Of the Consumer Code. The user is therefore invited to refer to these provisions should they wish to obtain further details on these statutory warranties.

All disputes relating to a sale concluded under these general terms and conditions of sale — concerning their validity, interpretation, performance, termination, consequences and repercussions, and which could not be resolved between the seller and the customer — may be submitted to the competent courts under the conditions of common law.

In the event of a dispute, the Customer is informed that they may, at any stage, resort to conventional mediation in order to find an amicable resolution before taking any legal action, in particular with the Consumer Mediation Commission (C. Consom. Art. L 612-1) or with existing sectoral mediation bodies, the details of which can be found on the website www.cm2c.net .

Claims: Upon receipt of the items, the customer must immediately check the condition and conformity of the items with respect to the order, in particular the quality and quantity of the items and their characteristics. If the items do not conform to the order or are damaged, the customer must raise reservations and claims with the carrier, or refuse delivery if the parcel has been opened or damaged, and send their claims by email to serviceclient@soeur.fr within 15 (fifteen) days of delivery. The customer must then specify and justify the grounds for the claim in full. No claim will be considered if the use of the items is deemed disproportionate. No spontaneous return, without the agreement of Soeur, will be accepted, except in the exercise of the right of withdrawal.

Legal warranty: The items sold are also covered by the legal warranty of conformity provided for in Articles L. 217-4 to L. 217-13 of the Consumer Code, and by the warranty relating to defects in the goods sold, under the conditions set out in Articles 1641 to 1648 and 2232 of the Civil Code. In accordance with the provisions of Article L. 217-15 of the Consumer Code, Articles L. 217-4, L. 217-5 and L. 217-12 of the Consumer Code, as well as Article 1641 and the first paragraph of Article 1648 of the Civil Code, are reproduced in full below.

Soeur grants a commercial warranty of one year from the date of purchase, covering any issue related to a quality defect in the product.

Article L. 217-4 of the Consumer Code

"The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.

The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter has been made the seller's responsibility under the contract or has been carried out under the seller's supervision."

Article L. 217-5 of the Consumer Code

"The goods conform to the contract:

1° If they are fit for the purpose normally expected of similar goods and, where applicable:

- if they correspond to the description given by the seller and possess the qualities presented by the seller to the buyer in the form of a sample or model;

- if they possess the qualities that a buyer may legitimately expect having regard to public statements made by the seller, the producer, or their representative, in particular in advertising or labelling;

2° Or if they have the characteristics jointly agreed upon by the parties, or are fit for any special purpose sought by the buyer, brought to the seller's attention, and accepted by the seller."

Article L. 217-12 of the Consumer Code

"The action arising from a lack of conformity is time-barred after two years from the date of delivery of the goods."

Article 1641 of the Civil Code

"The seller is liable for the warranty in respect of hidden defects in the goods sold which render them unfit for the purpose for which they are intended, or which so diminish that use that the buyer would not have purchased them, or would only have paid a lesser price for them, had they known of the defects."

Article 1648, paragraph 1 of the Civil Code

"The action resulting from latent defects must be brought by the buyer within a period of two years from the discovery of the defect."

Except in the cases provided for in these general terms and conditions of sale, items sold are neither taken back nor exchanged.

When acting under the legal warranty of conformity, the consumer:

  • has a period of 2 (two) years from the date of delivery of the goods to take action;
  • may choose between repair or replacement of the goods, subject to the cost conditions set out in Article L. 217-9 of the Consumer Code;
  • is exempt from providing proof of the existence of the lack of conformity of the goods for 24 (twenty-four) months following delivery of the goods. The legal warranty of conformity applies independently of any commercial warranty granted.

The consumer may decide to enforce the warranty against hidden defects in the goods sold within the meaning of Article 1641 of the Civil Code. In that case, they may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

7. Signature and proof

In all cases, providing the bank card number online and the final validation of the order shall constitute proof of the order in its entirety, in accordance with the provisions of the law of 13 March 2000, and shall render due the sums committed by the entry of items listed on the order form.

This validation constitutes a signature and express acceptance of all transactions carried out on the site. However, in the event of fraudulent use of their bank card, the customer is invited, upon becoming aware of such use, to contact SOEUR by sending an email to serviceclient@soeur.fr.

SOEUR has an obligation of result for all stages of order processing as well as for the stages following conclusion of the contract.

Accordingly, SOEUR undertakes to describe with the utmost accuracy the products sold on the SOEUR website. However, SOEUR's liability could not be engaged in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by French case law. Likewise, SOEUR's liability cannot be engaged for any inconvenience or damage inherent in the use of the Internet network, in particular a service interruption, external intrusion or the presence of a computer virus.

All elements of the soeur.fr website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.

A user who has a personal website and wishes to place, for personal use, a simple link on their site directing to the SOEUR homepage must obtain prior authorisation from SOEUR.

In all cases, any link, even if tacitly authorised, must be removed upon simple request from SOEUR.

In the event that any clause of this contract is rendered null and void by a change in legislation, regulation or by a court decision, this shall in no way affect the validity and observance of these general terms and conditions of sale.

These conditions apply for the entire duration of the online availability of the services offered by SOEUR.

The archiving of order forms and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with Article 1348 of the Civil Code.

These conditions are governed by French law. The competent court in the event of a dispute shall be that of the defendant's place of domicile or, at the claimant's discretion, the place of actual delivery of the product.

What information is collected and why?

SOEUR collects and uses personal data in order to provide our services in the best possible conditions to users, and also to ensure the proper fulfilment of orders. Some of the data we collect may also be used by our trusted third-party providers, who may therefore have access to certain data.

The personal data recorded by SOEUR is as follows:

Order: When you create a customer account on our website, our systems record identification data required to place an order and dispatch your parcel: postal address, email, gender, phone number, surname, and first name.

When your order is confirmed, our systems collect billing and payment data: payment method, transaction history, and bank transaction number.

Are passwords and bank card numbers secure?
Passwords are encrypted and therefore remain secure. Regarding online payments, bank card numbers are also encrypted and we do not have access to them. Our banking provider, Ingenico Group, ensures the confidentiality of banking information.

Newsletters: When you sign up to our newsletter, our systems collect your email address in order to send you our newsletters on a regular basis. You may unsubscribe at any time:

How long do we retain your data?

We retain your personal data for an indefinite period. The data retention period also depends on the purpose of the processing.

For example, data collected during an order is retained until all administrative formalities have been completed, after which it is archived. Data collected when signing up to a newsletter, for example, will be retained until permanent unsubscription.
